These general terms and conditions of sale are concluded with the company EFFET PASSEMENTERIES SARL with capital of 45,933 euros, registered in the RCS (trade and companies register) of ST ETIENNE under the number 90B115, whose registered office is at 490 Route de la Merlanchonnière 42740 Saint-Paul-en-Jarez - FRANCE and with any person or entity wishing to place an order or purchase via the website www.effet-bijoux.com, hereinafter the client.
Any order placed on the website implies prior consultation of these general terms and conditions of sale and shall be considered as full and irrevocable acceptance thereof.
Article 1 : : Acceptance of these general terms and conditions of sale.
Customers acknowledge acceptance of these terms and conditions at the time of confirmation of the order by clicking on the acceptance of these general terms and conditions of sale. This confirmation of order constitutes the contract between the customer and EFFET PASSEMENTERIES and the website www.effet-bijoux.com.
EFFET PASSEMENTERIES reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable terms and conditions shall be those in force as on the date of order by the buyer.
The Customer is informed that the products are intended for consumers and not for professionals.
Article 2 : Ordering procedure
2.1 – Selection of products :
The website www.effet-bijoux.com allows you to order a selection of products for sale online from EFFET PASSEMENTERIES. When visiting the website, Customers can add the product they want to the basket by clicking on "add to basket" when hovering over the product. Customers may add as many products as they wish to the basket. Customers can find out the price of each product placed in the basket, the features and the total amount of the basket by clicking on “view my basket".
To proceed to the purchase, customers must sign in using the customer account, which must have been created beforehand. They must enter their personal information: surname, first name and email address.
2.2 - Order confirmation.
In order to confirm the shopping basket and place the order, Customers must have accepted the general terms and conditions of sale, as well as the privacy policy by ticking the box provided for this purpose. An automatically completed online form will then be displayed, summarising the price, taxes and delivery costs. Customers must then enter further personal information: billing details and choice of delivery. They must also choose the method of payment.
Orders placed by customers on the website shall not be considered as accepted until the order is confirmed by EFFET PASSEMENTERIES. Customers will receive an email acknowledging receipt and confirming the order and the total amount thereof.
Customers may only cancel orders on the express condition that the payment is not accepted.
Article 3 : offer.
Offers made on the website are subject to availability. The unavailability of a product is in principle indicated on the page of the product in question and customers can ask to be informed by email as to when the product is restocked. If customers decide to cancel orders because products are unavailable, EFFET PASSEMENTERIES undertakes to reimburse the full amount paid for the unavailable product, at the latest within 30 (thirty) days of payment.
Article 4 : 4.1 - Price, carriage, invoice.
The prices shown on the website are prices including VAT in euros taking into account the VAT applicable as on the day of the order; any change in the rate may be passed on to the price and EFFET PASSEMENTERIES reserves the right to modify its prices at any time, it being understood, however, that the price guaranteed to the customer is the one shown on the website at the time of purchase. Prices may be modified in the event of special offers throughout the year.
The amount displayed is binding and final. It does not include the delivery charges billed as extra. Customers may tick the "gift wrapping" option if they so wishes, in which case charges will be added automatically.
For deliveries outside the European Union, the customer must pay any customs duties and other taxes due for the import of products into the territory of delivery.
4.2 – Gift card.
Gift cards can be used as many times as the Customer wishes until the total credit is spent. In order to use gift cards, Customers must enter the code when confirming their basket in the space provided.
It is possible to change a product purchased with a gift card, however, it cannot be refunded.
If the amount of a purchase is greater than the credit available, the difference can be paid by all means of payment accepted by the EFFET BIJOUX website.
Gift cards can be purchased electronically and are available in digital format on the email address indicated by the customer, or in paper format and will be sent to the postal address indicated by the customer.
Products purchased using gift cards have the same guarantee policy as products purchased using other payment methods.
Article 5 : Colour/Care
The photographs in the catalogue are as accurate as possible, but cannot ensure a perfect match with the product offered, especially with regard to the colours, particularly given that computer screens can have significant differences in the rendering of the same colour. These colour rendering reservations are valid for all the products offered. Our articles are not washable.
Article 6 : Secure payment.
All data relating to the payment of your orders is encrypted so that the information you give us is protected during its transmission to our payment processing centre. The amount of your purchases made on the www.effet-bijoux.com website is that which appears when you confirm your order.
Customers undertake to pay the prices of the products ordered on the website (products and delivery costs)
Customer must pay for their orders:
- By credit card: VISA or Eurocard-Mastercard only. For online payment, the www.effet-passementeries-boutique.com website uses the Cyberplus secure payment solution managed by the Banque Populaire. The integrity of the data is ensured by the encryption method (compression of the message preventing any interpretation of it during its transmission of a few seconds) and ensures the customer absolute secure payment. The transaction is entirely carried out by the Banque Populaire banking network in such a way that neither the website, nor any other technical intermediary, can have knowledge of the bank details communicated (card number, date of validity and name of holder). The Banque Populaire is responsible for carrying out :
- the usual payment authorisation request,
- the payment itself (movement from customer account to EFFET PASSEMENTERIES account) if authorisation is granted.
Article 7 : Default of payment and retention of title.
The products ordered remain the property of EFFET PASSEMENTERIES until final and full payment of their price in accordance with the terms of Law No. 80 335 of 12 May 1980. EFFET PASSEMENTERIES reserves the right to reclaim the products ordered in case of default of payment. In this case and upon request from EFFET PASSEMENTERIES, customers agree to return any unpaid product, with all costs at their expense.
Article 8 : Execution of orders.
Orders are executed within the lead times specified on the website and at the time of order confirmation by EFFET PASSEMENTERIES.
Article 9 : Delivery.
Delivery is made to the address indicated in the order form.
The risks are borne by the buyer from the time the products have left the Effet Passementeries premises. In the event of damage during transport, the substantiated complaint must be notified to the carrier by registered mail with acknowledgement of receipt within three days of delivery.
Delivery times vary depending on the destination and are for given for information purposes. Delivery costs are calculated according to the delivery method chosen by Customers when confirming orders.
Customers receive an email when orders have been dispatched, containing the tracking number of the order, allowing them to track the delivery and to locate the product via the carrier's website. Delivery is deemed to have taken place when the product is handed over to the carrier responsible for delivery thereof. The delivery note issued by the carrier must be dated and signed by the customer when the product is delivered. This dated and signed delivery note shall constitute proof of transport and delivery.
Although we will do our utmost to deliver within these lead times and to inform you directly if they are likely to be exceeded, this estimate is purely for information purposes and cannot be used as a basis for any claim
Article 10 : Guarantee.
EFFET PASSEMENTERIES offers a 6-month commercial guarantee on all jewellery from the date of purchase.
Excluded from the guarantee are defects resulting from abnormal use of the product: shocks, blows, crushing, exposure to detergents or wear and tear, ageing of the jewellery or wear due to the acidity of the skin. The products delivered are systematically checked by EFFET PASSEMENTERIES before being sent. They have undergone all the necessary treatment to ensure that they comply with the description on the website.
The photos and colour charts presented on our online store and on our Instagram page are not binding. They cannot give rise to any dispute, challenge the order or engage our liability in any way whatsoever. EFFET PASSEMENTERIES can in no way be held liable for any damage that may occur as a result of improper use of products delivered.
Article 11 : Returns
Returns shall only be accepted if made within 3 days of receipt of the parcel and must be sent by registered mail with a return signature at the buyer's expense. This refund shall be made by cheque.
To return a product, customers must complete the return form given to them after contacting contact@effet-bijoux.com by email or by phone +33 (0)4 77 73 74 40.
All products must be returned in their original packaging, intact and unworn. To do this, Customers must leave the small coloured thread on the jewellery which proves that the jewellery has not been worn.
Article 12 : Intellectual property
All elements of the EFFET PASSEMENTERIES website are and remain the exclusive intellectual property of Effet Passementeries.
No one is authorised to reproduce, exploit, retransmit or use in any way whatsoever, even partially, elements of the site, whether software, visual or sound.
